Costco shopper alleges unmarked curb caused fall

CLEARWATER – A Dunedin woman alleges she was injured when an unmarked curb at a warehouse club caused her to trip and fall.

Patricia Grube filed a complaint on April 10 in the 6th Judicial Circuit Court of Pinellas County against Costco Wholesale Corp. alleging negligence.

According to the complaint, the plaintiff alleges that on Sept. 5, 2017, while she exited defendant's store at the Clearwater Mall, she tripped on an unmarked curb, fell and was injured.

The plaintiff holds Costco Wholesale Corp. responsible because the defendant allegedly failed to mark the change in elevation of the curb, failed to give warning of any latent or unrevealed dangers upon exiting the store, and failed to properly inspect and maintain premises.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount of more than $15,000, plus costs, attorneys’ fees, and for such other relief to which the plaintiff may be justly entitled. She is represented by Robin Nightingale of Nightingale Law Firm in Safety Harbor.
