Horseback rider alleges farm's negligence led to injuries

CLEARWATER — A Pennsylvania woman suing a horseback and trail riding company, alleging failure to keep an individual safe while horseback riding.

Judith Zimmerman of Pleasant Gap, Pennsylvania filed a complaint April 9 in Pinellas County Circuit against Monica Bruehsel, doing business as Cypress Breeze Farm, and Freedom Entertainment Inc., alleging failure to exercise reasonable care in the purchase, training and selection of horses for the guided tour.

According to the complaint, on May 20, 2017, Zimmerman paid the defendants for a guided horseback tour on the defendant’s property in Pinellas County. Zimmerman says she was caused to fall when the horse she riding became agitated and threw her off. 

As a result, Zimmerman says, she sustained serious bodily injuries and incurred medical expenses for her care and treatment and in an effort to alleviate and cure her injuries. 

The plaintiff alleges Cypress Breeze Farm and Freedom Entertainment failed to provide Zimmerman with any training or instruction prior to the use of the horse and failed to provide training or instruction that they knew, or through the use of reasonable care should have known, given the rider's inexperience and/or the nature of the horse.

Zimmerman seeks trial by jury, damages in excess of $15,000, plus interest and attorney fees. She is represented by attorney William R. Gower, III of Banker Lopez Gassler PA in Tampa.
