Winter Park property owner alleges insurance company failure to provide coverage

ORLANDO — A Winter Park property owner is suing an insurance company, alleging breach of contract.

Bina Patel filed a complaint March 29 in Orange County Circuit Court against American Integrity Insurance Company of Florida, alleging failure to provide insurance coverage to the insured.

According to the complaint, on Sept. 10, 2017, Patel notified American Integrity of the dwelling damage that her property at 5562 Pats Point, Winter Park, had sustained. The suit says Patel has complied with all conditions to entitle her to recover under the policy. 

However, despite having a full force and effect insurance policy, Patel says she has failed to receive any insurance coverage to cover the property damage. 

The plaintiff alleges American Integrity Insurance of Florida has failed or refused to fully perform under the policy and failed to fully pay all of the insured's losses as required by the insurance policy.

Patel seeks trial by jury, damages of more than $15,000, plus losses with interest on any overdue payments, attorney fees and court costs. She is represented by attorney Gina Kimmel of Morgan & Morgan PA in Orlando.
