Customer blames Clearwater restaurant for injuries

CLEARWATER — A customer is suing owners of a Clearwater restaurant, alleging negligence led to injuries for the plaintiff.

Johnny Faye Barton filed a complaint March 13 in Pinellas County Circuit Court against Neighborhood Restaurant Partners Florida, LLC and Kimco Realty Corporation, alleging failure to to keep its premises in a reasonably safe condition for the protection of all members of the public.

According to the complaint, on July 5, 2016, Barton entered the business at 30180 U.S. Highway 19 N. Clearwater. The suit says Barton sustained injuries due to slipping on a substance pooling in the parking lot that was leaking and/or draining from the store. 

As a result, Barton says she suffered disability, mental anguish and expense of hospitalization, plus medical and nursing care and treatment. 

The plaintiff alleges the defendants failed to use reasonable care when it allowed a dangerous condition to remain on the premises, causing a slipping hazard.

Barton seeks trial by jury, damages in excess of $15,000, plus court costs. She is represented by attorney John L. Mulvihill of Corless Barfield Trial Group LLC in Tampa.
