ORLANDO — Two Orlando property owners are suing an insurance company, alleging breach of contract.
Romanchai Mosai and Subhadra Mosai filed a complaint Feb. 26 in Orange County Circuit Court against Florida Specialty Insurance Company, alleging the defendant failed to comply with its obligations required under the contract.
According to the complaint, on Sept. 10, 2017, the Mosais' home at 9112 Dollanger Court, Orlando, sustained covered wind damage due to Hurricane Irma. The suit says the Mosais notified Florida Specialty of the loss and have complied with all conditions under the policy.
However, the plaintiffs allege they have failed to receive any insurance coverage to bring the property into its pre-loss condition as required by the insurance contract and Florida law.
The plaintiffs allege Florida Specialty Insurance has failed and/or refused to reimburse the insured parties and place the home and personal property in its pre-loss conditions.
The Mosais seeks trial by jury, damages of more than $15,000, plus interest on any repairs necessary to place their dwelling in it pre-loss condition, plus attorney fees and court costs. They are represented by attorney Paul T. Zeniewicz of PZ Law Firm, PA in Orlando.
