CLEARWATER — A Kenneth City property owner is suing Family Dollar Stores, alleging breach of contract.

Plaza 66 LLC filed a complaint Feb. 14 in Pinellas Circuit Court against Family Dollar Stores of Florida Inc., alleging the tenant owes more than $54,000.

According to the complaint, on June 7, 2001, Family Dollar entered into an agreement with the previous property owners to lease space on 66th Street North, Kenneth City. The suit says Plaza 66 has suffered monetary damages due to Family Dollar's breaching of the terms of the lease by failing and refusing to pay the required rent of $54,874.51 for the leased premises.

The plaintiff alleges Family Dollar Stores of Florida has refused to pay the required rent amounts and obligated Plaza 66 to retain an attorney to protect its interest.

Plaza 66 seeks trial by jury, damages, payment of $53,874.51 under the lease, court costs and expenses, and all further relief the court deems just. It is represented by attorneys Mark J. Ragusa and Sarah K. Vespa of Gunster, Yoakley & Stewart PA in Tampa.
