ORLANDO — An Orlando man is suing Save A Lot, alleging negligence led to injuries for the plaintiff.
Roberto Cotto filed a complaint Feb. 8 in Orange County Circuit Court against Save A Lot LLC, alleging failure to provide a safe environment for its business invitees.
According to the complaint, on Dec. 12, 2015, Cotto was on the Save A Lot's premises, 702 S. Goldenrod Road, Orlando to shop. The suit says Cotto suffered serious and permanent injuries to his body after being struck by an object protruding from a cart.
The lawsuit says as a result of Save A Lot's negligence, Cotto sustained pain and suffering, disability, disfigurement, mental anguish, loss of earnings and aggravation of previous existing conditions.
The plaintiff alleges Save A Lot failed to adequately warn him of the dangerous condition, failed to safely maintain and/or operate the cart, and failed to have a sentry or support staff to properly monitor and supervise the operation of the carts.
Cotto seeks trial by jury, damages in excess of $15,000, plus interest and court costs. He is represented by attorney Steven J. Tomesko of Dan Newlin & Partners in Orlando.
