CLEARWATER — A St. Petersburg apartment tenant is suing his landlord/owner, alleging negligence in the collapse of the plaintiff's apartment floor.

James Bryant filed a complaint Feb. 6 in Pinellas County Circuit Court against Pallega LLC, alleging the defendant owed a duty to reasonably inspect, maintain, and repair its property so that floors on the premises were safe for persons using them.

According to the complaint,  on June 27, 2017, while Bryant walking in the leased apartment at the defendant's Northside Apartments in St. Petersburg, the floor collapsed beneath him, causing him to sustained bodily injuries and resulting in pain and suffering.

The plaintiff alleges Pallegar breached its duty of care and implied warranty of habitability by failing to reasonably inspect, maintain and repair the apartment premises so that the floor would not collapse and fall.

Bryant seeks trial by jury, damages of more than $15,000 and all other relief deemed just. He is represented by attorney Carey Blaxberg of Yanchuck & Blaxberg, PLLC in St. Peterburg.
