A property owner is suing insurer for breach of contract

ORLANDO — A property owner is suing Avatar Property & Casualty Insurance Company, an insurer, citing alleged breach of contract.

Sheher Yar Khan filed a complaint on Feb. 2 in the Orange Circuit Court against Avatar Property & Casualty Insurance Company alleging that the insurer breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that on June 1, 2015, while his property's insurance was in full force and effect, it sustained a covered loss as a result of a storm. However, despite efforts of plaintiffs to furnish timely notice of covered loss, the defendant refused to pay all of plaintiff's claim. 

The plaintiff holds Avatar Property & Casualty Insurance Company responsible because it allegedly failed to honor the policy by not paying plaintiff in full for the damages sustained to his property and forced plaintiff to retain an attorney to enforce the defendant's obligation to the insurance contract.

The plaintiff requests a trial by jury and seeks judgment against Avatar for damages, interest, costs and attorney's fees. He is represented by Peter A. Shapiro of The Law Offices of Peter A. Shapiro in Orlando.
