Naples couple alleges insurance company failed to cover property damages

ORLANDO — Naples property owners are suing an insurance company, alleging breach of contract.

Hugo Feliciano and Ana Feliciano filed a complaint Feb. 1 in Orange County District Court against Modern USA Insurance Company, alleging the defendant refused to comply with its obligation to provide insurance coverage.

According to the complaint, on April 24, 2017, while the Felicianos' policy with Modern USA was in full force and effect, their insured property at 10384 Majestic Circle, Naples, sustained a direct physical loss.

The suit says the Felicianos timely filed suit but the defendant has not performed its obligations, which includes investigation of the loss and adjusting the covered claim. 

The plaintiffs allege Modern USA Insurance failed to provide a coverage determination as to the subject loss and failed to provide factual support of its assertion that the loss and claim are excluded from coverage under the policy's terms.

The Felicianos seek trial by jury, damages of more than $15,000, attorney fees and court costs. They are represented by attorney Kenneth R. Duboff of Duboff Law Firm in North Miami.
