CLEARWATER — A Gulfport couple is suing an insurer, alleging breach of contract.
Peter and Sandra Kirtland filed a complaint Jan. 10 in Pinellas Circuit Court against AIG Property Casualty Company, alleging failure to cover damages from water and mold.
According to the complaint, on June 6, 2016, the Kirtlands discovered a direct physical loss to their insured home, 6109 Pensacola Point Blvd., Gulfport, in the form of water damage and mold. However, the suit says, AIG has refused to pay the full amount of benefits owed under the policy for the loss.
The plaintiffs allege AIG Property Casualty forced the Kirtlands to retain the services of a law firm to represent them in the matter, and breached its obligations under the policy by failing to pay benefits.
The Kirtlands seek trial by jury, damages of more than $15,000, interest, court costs, attorney fees and all other relief the court deems just. They are represented by attorneys Lee D. Gunn IV and Scott A. Arthur of Gunn Law Group PA in Tampa.
