Consumer accuses Florida company of violating FCCPA

CLEARWATER — A Pinellas County man is suing a Florida company, alleging illegal actions in trying to collect and alleged debt.

Matthew Reed filed a complaint Jan. 10 in Pinellas Circuit Court against Rent N Roll LLC, alleging violation of the Florida Consumer Collection Protection Act. 

According to the complaint, on Jan. 23, 2017, Reed and Rent N Roll entered a rent to own agreement for the tires on the plaintiff's car. The suit says Reed has suffered from anxiety, sleeplessness, loss of appetite, and other such manifestations of emotional distress, as a result of the defendant's conduct in sending threatening text messages on a non-stop and frequent basis.

The lawsuit states Rent N Roll is attempting to recover the tires, despite repeated notice by Reed that his vehicle was repossessed and that the defendant would have to contact the finance company directly to get the tires back. 

The plaintiff alleges Rent N Roll threatened him with criminal prosecution, and contacted Reed on numerous occasions, continuing undeterred in its campaign of harassment and abuse.

Reed seeks trial by jury, damages of at least $15,000, interest, court costs and attorney fees, statutory damages of $1,000 per violation, and all further relief the court deems just and proper.
