Clearwater homeowner alleges insurer failed to cover storm damages

CLEARWATER — A Clearwater homeowner is suing an insurance carrier, alleging breach of contract.

Michelle Craddock filed a complaint Jan. 5 in Pinellas Circuit Court against Citizens Property Insurance Company, alleging failure to cover property damages from a hurricane. 

According to the complaint, on Sept. 10, 2017, Craddock was financially damaged when her insured property at 2479 Hickman Circle, Clearwater, suffered direct physical damage and loss as a result of Hurricane Irma. The suit says although the loss was a covered peril under the terms of the insurance policy with Citizens Property, the defendant has refused to provide coverage. 

The plaintiff alleges Citizens Property Insurance has breached the contract by failing to provide full coverage under the policy and has failed to pay promptly the full amounts due the plaintiff.

Craddock seeks trial by jury, damages of at least $15,000, including actual and compensatory damages, prejudgment interest, costs of action, attorney fees and all further relief the court deems appropriate. She is represented by attorneys Grant W. Krapf and Kyle Staggs of Krapf Legal PA in Dunedin.
