Orlando homeowner alleges insurance company failed to pay for hurricane damage

Insurance 06

ORLANDO — An Orlando homeowner is suing an insurance company, alleging breach of contract.

Maria Figueroa filed a complaint Jan. 3 in Orange County Circuit Court against Universal Property and Casualty Insurance Company, alleging the defendant failed to provide coverage for hurricane damages.

According to the complaint, Figueroa sought homeowners' insurance coverage from Universal to cover structural damages to her properties, specifically the property at Bumby Avenue in Orlando, which was damaged by Hurricane Irma. The suit says despite Figueroa performing all conditions precedent to entitle her to recover under the policy, she has failed to receive any payment necessary to cover for the property loss.

The plaintiff alleges Universal Property and Casualty Insurance has refused and continues to refuse payment for all of the policy owner's covered losses and failed to pay the statutory interest, penalties and the statutory attorney fees required by law.

Figueroa seeks trial by jury, all covered losses of at least $15,000, plus interest on any overdue payments, attorney fees and court costs. She is represented by attorney Lee Michael Jacobson of Hale, Hale & Jacobson PA in Orlando.
