Policy owner alleges insurance company failed to cover auto damages

ORLANDO — A Lake County policy owner is suing an insurance company, alleging breach of contract.

Maricia Aiken filed a complaint Jan. 2 in Orange County Circuit Court against Direct General Insurance Company, alleging the defendant wrongfully denied the plaintiff's claim and canceled the policy after a vehicle crash.

According to the complaint, on July 24, 2017, while the policy with Direct General was in full force and effect, Aiken's car was involved in a motor vehicle accident in Orange County. Following the accident, Aiken says she timely notified the defendant of the claim but the insurer has denied the claim and canceled the insurance policy. 

The plaintiff alleges Direct General Insurance continues to fail and/or refuse to pay the insurance claim as required in the policy contract and has canceled the contract of insurance retroactive to its inception.

Aiken seeks trial by jury, compensatory damages of at least $15,000, interest, court costs, and reasonable attorney fees. She is represented by attorney Derek L. Metts of Metts Legal, PA in Winter Park.
