Customer blames Winn-Dixie negligence for injuries

CLEARWATER — A Pinellas County woman is suing Winn-Dixie, alleging negligence led to her suffering injuries.

Kimberly Hubbard filed a complaint Jan. 4 in Pinellas Circuit Court against Winn-Dixie Stores Inc., alleging failure to maintain its premises in a safe condition.

According to the complaint, on April 25, 2016, Hubbard was at the Winn-Dixie, 2139 34 St. N., St. Petersburg. The suit says Hubbard slipped and fell, leading to serious and permanent injuries, inconvenience, disability, mental anguish, aggravation of an existing condition, and medical expenses.

Hubbard says her injuries resulted from Winn-Dixie's negligence in allowing a large puddle of water in the aisle where customers traverse. 

The plaintiff alleges Winn-Dixie Stores breached its duty to properly maintain the premises to prevent dangerous conditions, and failed to warn customers of the dangerous conditions.

Hubbard seeks trial by jury, judgment in excess of $15,000, plus court costs and all other just relief. She is represented by attorneys Royce C. Haddad Jr. and Adam J. Talley of Haddad & Associates in Clearwater.
