ORLANDO — A Clay County couple is suing a Walt Disney resort, alleging negligence caused injuries to the husband on a stairwell.
Gerald Dalager III and Leah Dalager filed a complaint Dec. 26 in Orange County Circuit Court against Walt Disney Parks & Resorts U.S. Inc., doing business as Disney's Pop Century Resort, alleging failure to maintain its premises in a reasonably safe condition and/or to warn invitees of any dangerous condition.
According to the complaint, on Oct. 7, 2016, Gerald Dalager was an invitee at the defendant's Pop Century Resort for the purpose of lodging. The suit says he slipped and fell from an exterior stair. Dalager says the stairs should have had painting on the steps without non-slip additives.
As a result, Dalager says, he sustained bodily injuries, the expense of hospitalization, medical and nursing care and treatment. The suit says this caused inconvenience to him and his wife, Leah Dalager.
The plaintiffs allege Pop Century Resort failed to warn invitees of the dangerous condition of the stairs, failed to correct the dangerous condition and failed to divert invitees away from the dangerous stairs.
The Dalagers seek trial by jury, damages in excess of $15,000, exclusive of attorney fees, court costs and interest. They are represented by attorneys Adam W. Charlet and Judith Belorme of Ronald E. Sholes PA in Jacksonville.
