Orange County couple alleges insurer failed to pay for loss

ORLANDO — A Gotha couple is suing an insurance company, alleging breach of contract.

David and Laura Cristina Chylinski filed a complaint Dec. 18 in Pinellas Circuit Court against Tower Hill Preferred Insurance Company alleging failure to cover insured property damage. 

According to the complaint, on May 25, 2017, while the policy was in full force and effect, the Chylinskis were wrongfully denied coverage for a covered loss to their property at 9102 Lake Fischer Blvd., Gotha. The suit says this wrongful decision has caused the plaintiffs to suffer economic harm. 

The plaintiffs allege Tower Hill Preferred Insurance forced the Chylinskis to retain an attorney to bring action, and breached the insurance contract by refusing to fully pay the plaintiffs' claim.

The Chylinskis seek trial by jury, compensatory damages of more than $15,000, interest, costs and attorney fees. They are represented by attorney Derek L. Metts of Metts Legal PA in Winter Park.
