Couple blames Kissimmee resort for wife's pool injuries

ORLANDO — A couple is suing Kissimmee recreational facilities, alleging negligence and loss of consortium regarding pool injuries to the wife.

Dominique Vincent and Jacob Vincent II filed a complaint Dec. 11 in Orange County Circuit Court against Westgate Vacation Villas LLC, doing business as Westgate Town Center Resort & Spa, alleging the defendant failed to use reasonable care to maintain the premises in a reasonably safe condition for the safety of visitors and guests. 

According to the complaint, on Aug. 6, 2015, Dominique Vincent was a guest at Westgate Vacation Villas in Kissimmee owned and operated by the defendant. The suit says she suffered a broken ankle or leg while sliding into the swimming pool. Vincent alleges her foot forcefully struck the bottom of the swimming pool, causing serious injuries. 

As a result, Jacob Vincent says he was deprived of the services, comfort, society and consortium of his wife. 

The plaintiffs allege Westgate Town Center Resort & Spa failed to install, position, maintain, inspect or repair the swimming pool water slide, failed to correct the dangerous condition and failed to prevent or warn visitors from using the swimming pool water slide.

The Vincents seek trial by jury, compensatory damages in excess of $15,000 and costs of action. They are represented by attorney Alan F. Wagner of Wagner McLaughlin, PC in Tampa.
