Visitor alleges Walt Disney Park failed to provide safe railings

ORLANDO — A tourist is suing Walt Disney Parks, alleging negligence led to injuries for the plaintiff.

Pamela S. Balak filed a complaint Dec. 11 in Orange County Circuit Court against Walt Disney Parks and Resorts U.S. Inc., alleging the defendant negligently caused or permitted a dangerous condition to remain at its premises.

According to the complaint, on Feb. 28, 2014, Balak was at Walt Disney Park. The suit says while using transportation to and from Disney Park, Balak fell due to improper safety protocol for ingress/egress on the public transportation offered by Disney. 

Balak says the guard railings were not safe for mobility-impaired guests who were entering and exiting the bus provided for guests' transportation. 

As a result, Balak says she sustained bodily injuries, mental anguish and medical-related expenses. 

The plaintiff alleges Walt Disney Parks and Resorts U.S. failed to take reasonable precautions to prevent injury to guests, failed to provide hand railings or other preventive fall measures and failed to warn invitees of the dangerous condition.

Balak seeks trial by jury, judgment in excess of $15,000, plus court costs and interest from the date of the incident. She is represented by attorney Hans Peter B. Haahr of Haahr Law Group PL in St. Petersburg.
