Orlando property owner alleges insurance company failed to pay for water damage

ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.

Jo Ann C. Dyer, by Nancy Dyer Cohen and William Douglas Dyer as power of attorney, filed a complaint Dec. 1, in Orange County Circuit Court against Capitol Preferred Insurance Company Inc., alleging the defendant breached good faith and fair dealing by failing to cover water damage.

According to the complaint, on Feb. 6, 2017, Jo Ann Dyer's home at 1220 Bryn Mawr St., Orlando, sustained water damage, while her policy of homeowners insurance was still in full force and effect. However, the suit says, the defendant has refused to provide coverage for the loss. 

The plaintiff alleges Capitol Preferred Insurance breached an insurance contract by its refusal to pay to replace and/or repair the plaintiff's dwelling, and obligated the plaintiffs to retain the services of an attorney.

Jo Ann Dyer seeks trial by jury, all covered losses with interest of more than $15,000, plus any overdue payments, attorney fees and court costs. The plaintiffs are represented by H. Xavier Carrera of The Nation Law Firm LLP in Longwood.
