Motorist seeks damages from driver, Progressive American Insurance after Clearwater collision

CLEARWATER – A Pinellas County man is seeking underinsured motorist coverage from his insurer after a collision in Clearwater.

Paul Dombroski filed a complaint on Nov. 29 in the 6th Judicial Circuit of Florida - Pinellas County against Lucy Juanita Linder and Progressive American Insurance Co. alleging negligence.

According to the complaint, the plaintiff alleges that on Feb. 22, 2015, he was operating his Ford Mustang northbound in the curb lane of Hercules Avenue in Clearwater when his vehicle was struck by defendant Linder's vehicle. The plaintiff claims his vehicle was insured with defendant Progressive and that he timely filed for uninsured/underinsured motorist coverage but failed to be compensated for the damages incurred. 

The plaintiff holds defendants responsible because the defendant Progressive American Insurance Co. allegedly failed to compensate him under insurance coverage for the damages sustained, failed to comply with its contractual obligation and refused to indemnify him and Linder's alleged negligence caused him injuries.

The plaintiff requests a trial by jury and seeks judgment for damages of more than $15,000, plus interest and costs. He is represented by Andrew Klymenko, Jeffrey T. Coleman and Jeffrey R. Davis of Coleman & Klymenko LLC in St. Petersburg.
