Winter Park property owner alleges insurer failed to cover hurricane damage

ORLANDO — A Winter Park property owner is suing an insurance company, alleging breach of contract.

Eric Alvarez filed a complaint Nov. 27 in Orange County Circuit Court against Security First Insurance Company, alleging the insurer failed to cover damages caused by Hurricane Irma.

According to the complaint, on Sept. 10,  Alvarez's insured property at 2037 Linden Road, Winter Park, sustained direct physical damages from Hurricane Irma, which is a covered loss under the insurance contract. Although Alvarez provided prompt notice of the physical damages to Security First, it has refused to pay the insurance benefits. 

The plaintiff alleges Security First Insurance failed to provide coverage for the physical damages that occurred to Alvarez's insured property against terms of the contract, and obligated the plaintiff to pay for legal counsel.

Alvarez seeks trial by jury, damages of more than $15,000, declaratory relief, interest, attorney fees and court costs. He is represented by attorney Max M. Messinger of Kanner & Pintaluga PA in Boca Raton.
