Daughter accuses Dunedin medical facility of negligence

CLEARWATER — A personal representative is suing a Dunedin medical facility, alleging breach of fiduciary duty, negligence and wrongful death.

Wanda R. Hartsfield, representing the estate of her mother, Willie Zell Marcor, deceased, filed a complaint Nov. 21 in Pinellas Circuit Court against Manor Care of Dunedin FL LLC, Manor Care Inc., HCR Manor Care Inc. et al., alleging they failed to exercise standard care and skill required of medical providers and facilities.

According to the complaint, between Dec. 2, 2015, and Jan. 16, 2016, Marcor was a patient Manor Care Helath Services Dunedin The suit says on March 17, 2017, Marcor suffered bodily injury and resulting pain and suffering, disability, medical expenses, aggravation of a previously existing condition, and, ultimately, her untimely death.

The suit alleges her suffering was due to the negligence of the defendants in its care and treatment of the decedent. Furthermore, as Marcor surviving daughter, Hartsfield suffered the loss of support, services, companionship and guidance of a parent. 

The plaintiff alleges the defendants failed to maintain Marcor's appropriate medical records, failed to monitor significant signs and symptoms of change in Marcor's condition, and failed to properly train staff in the proper care and treatment of plaintiff.

Hartsfield seeks trial by jury, disgorgement of profits, consequential damages of more than $15,000, attorney fees and court costs, pre-judgment interest, and all other relief the court deems appropriate. She is represented by attorney Michael K. Beck of Wilkes & McHugh PA in St. Petersburg.
