CLEARWATER — A St. Petersburg shopping plaza owner is suing a tenant, alleging breach of contract.
Brixmor Skyway Plaza LLC filed a complaint Nov. 21 in Pinellas Circuit Court against Gail P. Harper, trading as World Changers Christian Academy, alleging it breached its duty of good faith and fair dealing.
According to the complaint, on June 30, 2016, Brixmor Skyway Plaza granted World Changers Christian Academy the right to use 1.927 square feet of commercial space at 1071 62nd Ave., S. St. Petersburg. The suit says Brixmor suffered economic damages when the tenant left the property Oct. 24, 2017, without paying rent and other charges due under the lease.
The plaintiff alleges World Changers Christian Academy obligated Brixmor Skyway to retain and pay for legal counsel to represent and protect its interest, and failed to pay the amounts due and owing.
Brixmor Skyway Plaza seeks trial by jury, damages of more than $15,000, attorney fees and court costs, interest, and all other just relief. It is represented by attorneys Jaime Austrich and April L. Zinober of Shumaker, Loop & Kendrick LLP in Tampa.
