St. Petersburg property owner alleges insurance carrier breached contract

CLEARWATER — A St. Petersburg property owner is suing an insurance carrier, alleging breach of contract.

Jalonda Fowler filed a complaint Nov. 20 in Pinellas Circuit Court against Homeowners Choice Property and Casualty Insurance Company, alleging the insurer breached good faith and fair dealing by failing to cover water damage.

According to the complaint, on May 8, Fowler suffered a covered loss due to water damage at 2196 63rd Ave. S., St. Petersburg. Although the defendant assigned a claim number and inspected the property, the insurer refused to pay for all of plaintiff's losses, the suit says. 

The plaintiff alleges Homeowners Choice obligated Fowler to pay for the services of legal counsel to represent and protect her interest, and refuses to pay the full amount of the plaintiff's insurance claim.

Fowler seeks trial by jury, declaratory judgment that the scope of damages and repairs claimed by the plaintiff of more than $15,000 are covered under the policy, plus attorney fees and court costs. She is represented by attorney Aboubakr Maaroufi of The Nation Law Firm in Longwood, Florida.
