CLEARWATER — A Pinellas County contractor is suing St. Petersburg property owners, alleging breach of contract.
PJ Callaghan Construction Inc. filed a complaint Nov. 20 in Pinellas Circuit Court against Fountainhead Resource Group LLC, doing business as Fountainhead Financial Management and Punch Management Group LLC, alleging they breached good faith and fair dealing in failing to pay for contracted work.
According to the complaint, on Jan. 23, 2017, PJ Callaghan Construction entered into an agreement for design and construction services to improve the defendants’ leased premises at 200 Central Ave., St. Petersburg. Subsequently, the suit says, PJ Callaghan completed the project and demanded payment, but the defendants have refused to pay and instead issued a worthless check.
The plaintiff alleges the defendants issued the worthless check as payment for PJ Callaghan's services with the intent to defraud, and breached their agreement through its refusal to honor its payment obligations.
PJ Callaghan Construction seeks trial by jury, damages of more than $15,000, disgorgement of all amounts by which the defendants have been unjustly enriched, and all other relief the court deems just.
