CLEARWATER — A tenant is suing Seminole apartment owners, alleging negligence led to injuries to the plaintiff.
Cindy Kay Owens filed a complaint Nov. 16 in Pinellas Circuit Court against Benchmark Ridgeview Associates Limited Partnership, Benchmark Management of Florida Inc. and Benchmark Seminole Properties Inc., alleging they failed to follow applicable safety guidelines and regulations.
According to the complaint, on June 21, 2014, as soon as Owens rented apartment 1302, 6321 113th St. N., Seminole, from the defendants, she noticed and complained about a defective sliding glass door. As a result of defendants' negligence in ignoring plaintiff's request, the suit says, on July 23, 2014, the defective door fell on Owens and caused her to strike her head on a corner of a table.
The lawsuit states Owens sustained injuries, pain and suffering, disability, inconvenience and aggravation of an existing disease or physical defect.
The plaintiff alleges the defendants allowed the defective door to be in a state of disrepair, failed to adequately warn Owens of the dangerous condition, and made no attempts to correct the defective sliding glass door.
Owens seeks trial by jury, damages of more than $15,000, plus court costs and all other just relief. She is represented by attorneys Thomas D. Roebig Jr., Nicholas S. Costantino, Shaun M. Cummings, Luca G. Esposito, Chase P. Florin and Chad K. Florin of Florin Roebig PA in Palm Harbor.
