ORLANDO — A Seminole County woman is suing BJ's Wholesale Club, alleging negligence led to the plaintiff falling and suffering injuries.
Eva Espinal of Winter Springs filed a complaint Nov. 16 in Orange County Circuit Court against BJ's Wholesale Club Inc. alleging failure to use due care to maintain its premises in a safe condition.
According to the complaint, on Oct. 28, 2016, Espinal visited BJ's Wholesale Club at 12090 Lake Underhill Road, Orlando. The suit says Espinal slipped and fell on an unknown substance on the floor of its store, and sustained injuries in and about her body and extremities. The lawsuit says the fall resulted in pain and suffering, disability, disfigurement, scarring, medical expenses, loss of earning, and aggravation of previous existing condition.
The plaintiff alleges BJ's Wholesale Club failed to have adequate staff on duty and/or assigned to the task of inspecting the premises, failed to inspect or adequately warn the Espinal of the dangerous condition, and failed to render aid to plaintiff after her fall.
Espinal seeks trial by jury, judgment in excess of $15,000, plus interest and court costs. She is represented by attorney Harran E. Udell of Morgan & Morgan PA in Orlando.
