Couple alleges State Farm failed to cover car crash damages

CLEARWATER — A Pinellas County couple is suing State Farm, alleging breach of contract.

David Woodward and Debra Woodward filed a complaint on Nov. 15, in the Pinellas County Circuit Court against State Farm Mutual Automobile Insurance Company alleging that the licensed insurer breached its duty of good faith and fair dealings.

According to the complaint, on Aug. 31, David Woodward was driving his 2006 Dodge westbound in a construction zone on Interstate Highway 90 in Campbell, Wisconsin. The suit says an uninsured F-350 truck driven by Davey Peterson rear-ended Woodward's vehicle. 

As a result of the the collision, Woodward says he sustained serious bodily injuries and resulting pain and suffering, mental anguish, loss of capacity for the enjoyment of life and incurred medical and treatment expenses. Debra Woodward alleges she has been denied of the services, comfort, society, attention and consortium of her husband. 

The plaintiffs alleges State Farm has failed and refused to pay all benefits to which they are entitled and failed to provide coverage for the uninsured motorist, which is covered under State Farm policy.

The Woodwards seek trial by jury and damages. They are represented by attorneys Justin C. Johnson and Christopher M. Rotunda of Justin C. Johnson & Associates PA in St. Petersburg.
