Patron alleges Subway restaurant's negligence caused injuries

ORLANDO — An Orange County woman is suing the property owners of a Subway restaurant in Orlando, alleging negligence caused her injuries.

Mary Rodriguez Martinez filed a complaint Nov. 6 in Orange County Circuit Court against Dipasqua Enterprises Inc., alleging the restaurant property failed to provide a safe environment for its customers.

According to the complaint, on July 11, 2015, Martinez was at the Subway, 3838 S. Semoran Blvd., Orlando, attempting to order food, when she slipped and fell due to a slippery liquid substance on the floor. As a result of the defendant's negligence, the suit says, Martinez sustained severe and permanent injuries, physical and mental pain and suffering, grief, inability to lead a normal life, loss of earnings and permanent aggravation of a preexisting condition. 

The plaintiff alleges Dipasqua Enterprises failed to maintain the floor of the Subway in a reasonably safe condition, failed to warn of the dangerous condition that existed at that time, and failed to place barricades, wet floor signs, or other marking devices to alert plaintiff.

Martinez seeks trial by jury, general damages and all just relief. She is represented by attorneys Gordon Fenderson and Douglas W. Shanteau of Fenderson Law Firm LLC in Jacksonville.
