Assistant accuses Florida state attorney of disability discrimination

ORLANDO — A disabled Orange County woman is suing the state attorney for the Ninth Judicial Circuit, alleged discrimination and wrongful termination.

Kailey Evans filed a complaint Nov. 6 in Orange County Circuit Court against Aramis D. Ayala, in her official capacity as state attorney for the Ninth Judicial Circuit,  alleging violation of the Florida Civil Rights Act.

According to the complaint, Evans began working for the defendant Jan. 6, 2014, as assistant state attorney. The suit says in July 2016, Evans was accused by other employees of being crazy, unstable, mentally and emotionally unfit for duty and suggested that she go on FMLA leave. 

Evans says she was disciplined ostensibly for talking about her romantic relationship with a co-worker in the office, was transferred into another division, and then terminated Jan. 2, 2017. The plaintiff alleges Ayala discriminated against an employee because of her disability or because the defendant perceived Evans to have a disability.

The suit also states Ayala perceived an employee as having a substantial mental impairment and took adverse employment actions against her, including termination.

Evans seeks trial by jury, back pay, front pay, economic and non-economic compensatory damages of more than $15,000, punitive damages, attorney fees, court costs, interest and all other relief the court deems just and proper. She is represented by attorney Travis R. Hollifield of Hollifield Legal Centre in Winter Park.
