Customer blames Winn-Dixie for fall, injuries

CLEARWATER — A Pinellas County woman is suing Winn-Dixie, alleging negligence led to injuries for the plaintiff.

Twyla Gordon filed a complaint Nov. 8 in Pinellas Circuit Court against Winn-Dixie Stores Inc., alleging failure to provide a safe environment for its business invitees.

According to the complaint, on July 8, 2015, Gordon was a business invitee within the premises of the Winn-Dixie at 1500 Municipal Drive, Madeira Beach. The suit says she slipped on a clear liquid substance, fell and suffered serious bodily injuries, pain and suffering, loss of earnings, and/or aggravation of a previous existing condition. 

The plaintiff alleges Winn-Dixie Stores failed to provide patrons with warning of the dangerous condition within the premises, and allowed a clear liquid substance to exist in an area where customers were expected to traverse.

Gordon seeks trial by jury, damages in excess of $15,000, interest, attorney fees and court costs. She is represented by attorney Luis R. Gracia of Rue & Ziffra in Port Orange.
