Home buyer alleges sellers failed to disclose

CLEARWATER — A Pinellas County homeowner is suing sellers, alleging failure to disclose, breach of contract, negligence and negligent misrepresentation.

Christopher Dietz filed a complaint Nov. 7 in Pinellas Circuit Court against Jonathan Farris, Daniel Burns and Young Home Inspections, alleging they breached their duty of good faith and fair dealing.

According to the complaint, on June 4, Deitz entered into a contract with Farris to buy the property at 9962 56th Way N., Pinellas Park. On Aug. 31, the suit says, Dietz closed on the property only to learn within hours the property had significant water and termite damage.

The lawsuit states Dietz was damaged by the defendants' breach of the purchase and sale agreement and by the misrepresentation that the property Dietz has purchased was properly inspected and has no defects that could affect the value of the property. 

The plaintiff alleges the defendants failed to disclose of significant water and termite damage, and failed to perform its professional obligations to properly inspect and identify material defects in the property.

Dietz seeks trial by jury, damages of more than $15,000, interest, attorney fees, court costs and all other relief the court deems just. He is represented by attorneys William G. Lazenby, Jason M. Ellison and Brittney P. Baker of Ellison / Lazenby in St. Petersburg.
