Customer blames Brooksville property owner for injuries

CLEARWATER — A Homosassa man is suing Brooksville property and property and store owners, alleging negligence led to injuries for the plaintiff.

Troy Montgomery filed a complaint Nov. 7 in Pinellas Circuit Court against Ferguson Enterprises Inc., doing business as Ferguson Plumbing Supplies, and Angela Land LLC, alleging they failed to follow applicable safety guidelines and regulations.

According to the complaint, on March 4, 2015, Montgomery, who was recovering from right hip replacement surgery, was a customer at the defendant's store in Brooksville. The suit says,Montgomery tripped on the raised threshold at the bottom of the door opening, and fell face down to the concrete slab floor. 

As a result of the fall, Montgomery says he sustained permanent injuries and aggravation of pre-existing injuries, including total right hip replacement, resulting in pain and suffering, lost income, and medical expenses. 

The plaintiff alleges the defendants failed to maintain the property in a safe condition, and failed to warn Montgomery of the dangerous condition of its premises.

Montgomery seeks trial by jury, damages of more than $15,000, plus court costs, prejudgment interest and all other relief the court deems just. He is represented by attorneys Kennan G. Dandar and Timothy M. Dandar of Dandar & Dandar PA in Tampa.
