Medical transportation company accuses former employee of tortious interference

FORT LAUDERDALE — A Pompano Beach medical transportation company is suing a former employee, alleging defamation and retaliation.

Priority Care Transit LLC filed a complaint Nov. 1 in Broward County Circuit Court against Kelvin Ortiz, alleging the defendant engaged in intentional, malicious, bad faith and unjustified tortious conduct that interfered with the plaintiff's advantageous business relationships.

According to the complaint, on Oct. 16, Priority Care Transit decided to terminate Ortiz for the best interest of the company. The suit says Ortiz caused the the plaintiff to suffer damages in the form of losing private information, confidential account of clients, stolen properties and a system malfunction that it was no longer able to operate its usual business transactions. 

As a result, the company says it suffered loss of income and loss of its business reputation. 

The plaintiff alleges Ortiz showed blatant disregard for his former employers' business, patients and accounts by entering Priority Care's premises at 106 S. Federal Highway, Pompano Beach, without permission. The suit says Ortiz took all steps to delete software and shut down the Priority Care computer system to stop the company from operating its business.

Priority Care Transit seeks trial by jury, nominal and compensatory damages, interest, costs, and all other relief the court deems just and proper. It is represented by attorneys Alexandra Sierra-De Varona and Spencer E. Winepol of De Varona Law in Boca Raton.
