Policy holder alleges insurance company failed to cover property damage

FORT LAUDERDALE — A Weston property owner is suing Federated Insurance, alleging breach of contract.

Carol Schiller and Carol Schiller Revocable Living Trust filed a complaint Nov. 1 in Broward County Circuit Court against Federated National Insurance Company, alleging the defendant denied the insured's claim of coverage for damaged property.

According to the complaint, on July 13, with Schiller's policy with Federated in full force and effect, her property at 2694 Edgewater Court, Weston, sustained water damage. The suit says Schiller timely filed for coverage loss. 

The lawsuit states despite Federated acknowledging coverage and inspecting the property, Schiller was denied coverage after numerous fillings. 

The plaintiff alleges Federated National Insurance failed to provide coverage or payment for the damages stemming from the property loss as Schiller is entitled to under the policy.

Schiller seeks trial by jury, judgment for wrongfully denying coverage and payment to the insured, along with attorney fees and all further relief the court deems just and proper. She is represented by attorney S. Antonio Jimenez of Diverse Legal Solutions, A Law Firm in Miramar.
