FORT LAUDERDALE — A Broward County property owner is suing an insurance company, alleging breach of contract.
Yessy Felipe filed a complaint Nov. 1 in Broward County Circuit Court against SafePoint Insurance Company, alleging the defendant breached its contractual obligation by failing to pay for the sustained water damages to the insured's property.
According to the complaint, on Sept. 7, 2016, Felipe insured property at 4408 Johnson St., Hollywood, Florida, suffered a loss due to water discharge in the kitchen. Felipe says the damage is covered by his insurance and he timely filed claims with an estimated covered loss amounting to $25,217.98. Despite performing all obligations as an insured, Felipe alleges he was denied his coverage claim.
The plaintiff alleges SafePoint Insurance refuses to honor its contractual obligation to be a protector of the insured's assets and pay for the covered loss.
Felipe seeks trial by jury, judgment plus costs, damages of more than $15,000, prejudgment interest and attorney fees. He is represented by Cecile Mendizabal of Strems Law Firm in Coral Gables.
