Broward County property owner alleges insurance carrier breached contract

FORT LAUDERDALE — A Broward County man is suing an insurance carrier, alleging breach of contract for failure to cover water damages.

Gregor Phillippe filed a complaint Nov. 1 in Broward Circuit Court against Heritage Property & Casualty Insurance Company, alleging breach of good faith and fair dealing.

According to the complaint, on Aug. 1, Phillippe's property at 5741 W. Commercial Blvd., Tamarac, suffered covered losses caused by the sudden and accidental discharge from within a plumbing vessel. Although Phillippe says he has complied with and performed all conditions precedent to recover money under the policy, Heritage has refused to fully pay the amount of the insurance benefit due the plaintiff. 

The plaintiff alleges Heritage Property & Casualty Insurance has failed its duty to properly investigate, adjust, settle, and pay Phillippe for covered insurance claim.

Phillippe seeks trial by jury, consequential damages, attorney fees, interest, court costs and all further relief the court deems just. He is represented by attorney Jonathan Korin of Korin Law PA in Miami Lakes.
