FORT LAUDERDALE — A Broward County couple is suing an insurance company, alleging breach of contract for failing to pay for hurricane damages.
Jose R. Lopez Jr. and Guadalupe Lopez of North Lauderdale filed a complaint Nov. 1 in Broward Circuit Court against Florida Peninsula Insurance Company, alleging the insurer breached its duty of good faith and fair dealing.
According to the complaint, on Sept. 11, the Lopez property at 2000 SW 64th Ave., North Lauderdale, sustained damages due to Hurricane Irma that caused direct physical damages to the premises. Although the property was a covered peril under the policy issued by Florida Peninsula, the suit says, the defendant has refused to pay the full amount of insurance proceeds due the plaintiffs.
The plaintiffs allege Florida Peninsula Insurance obligated hte Lopezes to retain and pay for the services of a legal counsel to represent and protect their interest, and refused to pay the full amount of the plaintiffs' insurance claim.
The Lopezes seek trial by jury and all damages of more than $15,000, plus interest, court costs and attorney fees. They are represented by attorney Roger A. Alvarez of Miami.
