Tenant alleges Orlando condo owner's negligence caused injuries

ORLANDO — An Orange County woman is suing an Orlando condominium, alleging negligence caused injuries to the plaintiff.

Miriam Rodriguez filed a complaint Oct. 30, in Orange Circuit Court against The Hamptons at Metrowest Condominium Association Inc., alleging the property owner failed to use due care to maintain its premises in a safe condition.

According to the complaint, on Aug. 19, 2014, Rodriguez was a resident at the defendant's condominium 6401 Time Square Ave. A-1, Orlando. The suit says she was injured as she walked down the sidewalk in front of the condo building and caught her foot into a large crack. The lawsuit states the plaintiff was walking her dog at night and the light was dim.

As a result of the the defendant's negligence, Rodriguez says she incurred medical expenses for her care and treatment in an effort to alleviate and cure her injuries, sustained permanent impairment in the use of her right hand and wrist, and other consequential damages. 

The plaintiff alleges The Hamptons at Metrowest Condominium Association failed to repair the uneven surface of the sidewalk, failed to keep the sidewalk well lit, and failed to warn the plaintiff of the dangerous condition.

Rodriguez seeks trial by jury, compensatory damages of more than $15,000, cost of action, and all other just relief. She is represented by attorney Jeffrey S. Badgley of Badgley Law Group in Orlando.
