Agent accuses Scholastic for breach of contract

ORLANDO — A Florida man is suing Scholastic, alleging the New York publisher breached a contract.

Joe Jernigan filed a complaint Oct. 31 in Orange Circuit Court against Scholastic Inc., alleging the publisher breached its duty of good faith and fair dealing.

According to the complaint, on June 1, 2012, Jernigan suffered significant monetary damages, as a result of Scholastic's unlawful conduct. The suit says the defendant refused to pay the plaintiff his full commission from a multimillion dollar book sale, despite Jernigan having fully performed his duties as an account executive. 

The plaintiff alleges Scholastic refused to pay Jernigan the full commission he was owed, unlawfully reduced his commission after a sale has been consummated, and obligated Jernigan to hire attorneys to represent and protect her interest.

Jernigan seeks trial by jury, damages of more than $15,000, prejudgment interest, court costs, attorney fees, and all further relief the court deems just. He is represented by attorneys Benjamin A. Webster and John R. Moore of Morgan & Morgan PA in Orlando.
