Vehicle passenger alleges Progressive failed to provide insurance coverage

ORLANDO — A Lake County woman is suing Progressive Insurance, alleging she is entitled to uninsured/underinsured motorist protection coverage.

Theresa Martin filed a complaint Oct. 30, in the Orange Circuit Court against Progressive Select Insurance Company alleging failure to provide uninsured/underinsured motorist protection coverage.

According to the complaint, on Nov. 18, 2015, Martin was a passenger in a vehicle driven by Kristopher Morgan when the vehicle was struck by a car driven by Garfield Rapheal St. Hill. The suit says Martin suffered bodily injury, disability, scarring, medical expenses, aggravation of a pre-existing condition, and inconvenience.

The lawsuit says Martin's injuries were result of the negligent operation and/or maintenance of a motor vehicle by St. Hill, a uninsured/underinsured motorist, who caused the accident. Martin seeks uninsured/underinsured motorist protection coverage from Progressive, the insurer of the vehicle where she was a passenger during the crash. 

The plaintiff alleges Progressive had agreed to provide, among other things, underinsured motorist protection coverage to its insured and their passengers.

Martin seeks trial by jury, damages of more than $15,000, plus court costs. She is represented by attorney Jason J. Recksiedler of NeJame Law PA in Orlando.
