ORLANDO — A tenant is suing an Orlando apartment owner, alleging negligence in failing to keep the premises safe.
Mercedes Garcia filed a complaint Oct. 31 in Orange County Circuit Court against Blue Rock Partners, LLC, doing business as The Park at Cambridge, alleging that apartment owner breached its duty to design, construct, maintain and repair its Orlando property so as not to create a dangerous and defective condition.
According to the complaint, on March 5, 2016, Garcia, a tenant in the defendant's Park at Cambridge property in Orlando, tripped and fell due to a defective sidewalk leading to the apartment.
As a result, Garcia says she sustained physical injuries, mental anguish and incurred medical expenses.
The plaintiff alleges The Park at Cambridge failed to cordon off the area to prohibit tenants and their guests from walking through the area, failed to warn of the latent dangerous condition and failed to keep adequate and operational the artificial lighting in the area which would have illuminated the dangerous condition.
Garcia seeks trial by jury, compensatory damages in excess of $15,000 and costs of suit. She is represented by attorney David Kerce of Farah & Farah PA in Daytona Beach.
