Vehicle owners accuse towing company of unlawful acts

CLEARWATER — Two vehicle owners have filed a class action lawsuit against a St. Petersburg towing company, alleging strict liability.

Cindy Goldstein and April Goodwin filed a complaint, on behalf of themselves and all others similarly situated, Oct. 25 in Pinellas Circuit Court against Skyway Towing & Recovery Inc., alleging the defendant obtained profit through unfair or deceptive trade or commerce.

According to the complaint, Goldstein, Goodwin and other similarly situated individuals have suffered damages to their vehicles and costs of repair, because of the defendant's unlawful and improper towing and/or storage of their vehicles that were towed from parking spaces in St. Petersburg. The suit says Goldstein had to pay $109 to secure her Ford Focus and Goodwin had to pay $121 to secure her Dodge Magnum. Goodwin says she also had to pay $899.85 for damages to her car.  

The plaintiffs allege Skyway Towing & Recovery failed to include the legally required written disclosure, and was unlawfully removing vehicles from private properties without the owner’s consent in order to derive profit.

Goldstein and Goodwin seek trial by jury, damages of more than $15,000, certify the case as a class action, appoint class representative and counsel, attorney fees, injunctive and/or declaratory relief, court costs, interest and all further relief the court deems just. They are represented by attorneys Felipe B. Fulgencio and Bryan A. Giribaldo of Fulgencio Law PLLC in Tampa.
