Nissan employee alleges medical leave violation

CLEARWATER — A Pinellas County man is suing Nissan, alleging violation of the Family and Medical Leave Act (FMLA).

Petar Petrovic filed a complaint Oct. 26 in Pinellas Circuit Court against Lokey Nissan Inc., alleging the defendant violated rights of employees to family and medical leave.

According to the complaint, on Sept. 27, upon Petrovic's release back to work after being hospitalized for a serious health condition, Lokey Nissan retaliated against him for asserting his FMLA rights by not restoring him to the same or equivalent position. As a result of Lokey Nissan's unlawful conduct, Petrovic has suffered monetary damages. 

The plaintiff alleges Lokey Nissan engaged in reckless disregard of his legal rights under the FMLA, and retaliated against Petrovic for exercising his FMLA rights.

Petrovic seeks trial by jury, damages of more than $15,000, including back pay, front pay and benefits, interest, liquidated damage, injunctive and/or equitable relief, court costs, attorney fees and all other relief the court deems just. He is represented by attorneys Wolfgang M. Florin and Christopher D. Gray of Florin, Gray, Bouzas, Owens LLC in Lutz.
