CLEARWATER — A St. Petersburg man is suing an insurance company, alleging breach of contract.
Phillip Lindsay filed a complaint Oct. 24 in Pinellas Circuit Court against Heritage Property & Casualty Insurance Company, alleging breach of good faith and fair dealing.
According to the complaint, Lindsay's property at 1758 Maryland Ave. NE, St. Petersburg was insured when between Oct. 4, 2016-Oct, 4, 2017, it suffered damages. Although Lindsay says he complied with all conditions precedent to entitle him to recover losses under the policy, Heritage Casualty refused to pay for all the plaintiff’s losses.
The plaintiff alleges Heritage Property & Casualty forced Lindsay to retain the services of an attorney to represent him in the case, and failed to comply with the terms of the insurance policy.
Lindsay seeks trial by jury, judgment for all losses with interest on any overdue payments, attorney fees and court costs. He is represented by attorney Maria A. Morris of The Nation Law Firm LLP in Longwood.
