Couple alleges building contractor's negligence caused leaky roof

ORLANDO — An Orlando husband and wife are suing a building contractor, alleging breach of contract, breach of implied warranty, violation of building code and negligence.

Tony Vargas III and Tiffany A. Altizer filed a complaint Oct. 16 in Orange Circuit Court against Bianchi's Home Improvements Inc., alleging negligence in construction and breach of good faith and fair dealing.

According to the complaint, Vargas and Altizer suffered damages to their property at 1525 Nottingham St., Orlando from a leak on the roof. The suit says this was a result of Bianchi's negligent construction work in replacing portions of the roof system for the installation of new heating, ventilation and air conditioning) system. 

The plaintiffs allege Bianchi's Home Improvements failed to properly install and waterproof the project's roof system, refused to make adequate repairs and failed to address the water intrusion/leaks.

Vargas and Altizer seek trial by jury, actual damages of at least $15,000, damages from diminution in value, attorney fees and court costs. They are represented by attorneys B. Shane Boutty and James W. Markel of The Boutty Law Firm PA in Winter Park.
