Nursing home blamed for resident's death

CLEARWATER — A representative of a deceased man is suing a Daytona Beach nursing home, alleging negligence, and wrongful death.

Marcia F. Passo, as representative for James A. Evensen,  filed a complaint Oct. 19 in Pinellas Circuit Court against Alliance Foundation of Florida Inc., doing business as Indigo Manor, The Alliance Foundation for Housing and Health Care Inc., Alliance Foundation of Florida - Indigo Manor LLC and Healthpath Medical Center LLC, alleging failure to exercise the standard care and skill required of medical providers and facilities.

According to the complaint, on July 6, 2015, Evensen was suffering from urinary tract infection, urosepsis, malnutrition, dehydration, pneumonia, atrial fibrillation, sacral decubitus ulcer as a resident at Indigo Manor. The suit says Evensen was transferred to Halifax Hospital where he died July 10, 2015.

The lawsuit states Evensen's untimely death was the result of the defendants' negligence in the care, treatment and monitoring of their residents including Evensen. 

Passo alleges the defendants failed to provide adequate staff to assist with reasonable care, failed to properly supervise and monitor Evensen, failed to provide proper nutrition, and failed to properly inform the family and/or physicians of the decedent's condition.

Paso seeks trial by jury, all damages in excess of $15,000, exclusive of interest, plus court costs and attorney fees. She is represented by attorney Jason A. Paul of Paul & Perkins PA in Orlando.
