ORLANDO — A Lake County woman is suing Nationwide Insurance, alleging bad faith and breach of contract.
Robyn Holtzapple filed a complaint Oct. 17 in Orange County Circuit Court against Nationwide Mutual Fire and Insurance Company, alleging breach of good faith and fair dealings.
According to the complaint, on March 22, 2006, a car driven by Lisa Mari Talley collided with a vehicle driven by Holtzapple, leading to significant and permanent injuries to the plaintiff. The suit says on May 19, 2015, as a direct result of Nationwide's failure to resolve her claim, the court entered final judgment in Holtzapple's favor in the amount of $1,696,826, for which she is pursuing.
The plaintiff alleges Nationwide has failed to settle her claim within the policy limits when it could and should have done so.
Holtzapple seeks trial by jury, damages of at least $15,000, including, but not limited to, the unsatisfied $1,696,826 of the final judgment, pre- and post-judgment interest, court costs and all other relief the court deems equitable and proper.
